{"id":148,"date":"2015-02-09T16:10:58","date_gmt":"2015-02-09T16:10:58","guid":{"rendered":"http:\/\/zamzowlaw.com\/articles\/?p=148"},"modified":"2015-02-09T16:10:58","modified_gmt":"2015-02-09T16:10:58","slug":"real-estate-syndication","status":"publish","type":"post","link":"https:\/\/zamzowfabian.com\/articles\/real-estate-syndication\/","title":{"rendered":"Real Estate Syndication"},"content":{"rendered":"<p class=\"s2\"><span class=\"s4\">Broadly defined<\/span><span class=\"s4\">,\u00a0<\/span><span class=\"s4\">a real estate syndicate<\/span><span class=\"s4\">\u00a0pools\u00a0<\/span><span class=\"s4\">capital\u00a0<\/span><span class=\"s4\">from various investors\u00a0<\/span><span class=\"s4\">and then utilizes the capital to: acquire an income producing property; or, develop underutilized land on which an income property can be developed.\u00a0<\/span><\/p>\n<p class=\"s2\"><span class=\"s4\">A syndicate structure allows investors to invest<\/span><span class=\"s4\">\u00a0in<\/span><span class=\"s4\">\u00a0real estate venture they may be unable or unwilling to invest in individually.<\/span><span class=\"s4\">\u00a0Generally the investor is not involved in the day-to-day management of the project.<\/span><span class=\"s4\">\u00a0A common example of this would be the purchase of a residential apartment complex.\u00a0<\/span><\/p>\n<p class=\"s2\">Investing in a real estate syndicate requires due diligence and a careful analysis of the proposed venture; as there are no guarantees that the venture will be profitable. It is recommended that individuals seek the advice of a qualified attorney and or financial planner when evaluating a syndication offering to fully understand the merits and risks of the investment.<\/p>\n<p class=\"s2\"><span class=\"s4\">The organization that puts together the syndication, the syndicator generally is compensated for: locating th<\/span><span class=\"s4\">e real estate, due diligence of<\/span><span class=\"s4\">\u00a0the acquisition or intended development, and closing the deal. This compensation can be provided in a variety of ways including: acquisition fees &#8211; paid to the syndicator at closing; management fees\u00a0<\/span><span class=\"s4\">\u2013<\/span><span class=\"s4\">typically based on a percentage of yearly gross revenue; and, equity carve outs \u2013\u00a0<\/span><span class=\"s4\">permits<\/span><span class=\"s4\">\u00a0the syndicator or retain an equity interest in the project.\u00a0<\/span><\/p>\n<p class=\"s2\"><span class=\"s4\">The investor<\/span><span class=\"s4\">\u00a0can realize gains on his investment through the cash flows of the property, the appreciation of their ownership interest that will be realized upo<\/span><span class=\"s4\">n sale, and\/or a preferred return on their invested capital.\u00a0<\/span><\/p>\n<p class=\"s2\"><span class=\"s4\">Real estate syndication is regulated by the Federal and State government to protect the public as well as potential investors<\/span><span class=\"s4\">. This regulation can be very difficult to navigate as it is frequently changed, and many governmental agencies are involved in the process. Investing in\u00a0<\/span><span class=\"s4\">a real<\/span><span class=\"s4\">\u00a0estate syndication should only be done after a\u00a0<\/span><span class=\"s4\">thorough investigation of the syndicator and the investment.
